Legal Information
The naturist documentaries and books offered by Enature are protected forms of expression under United States law, including the First Amendment and related federal case law. Non-sexual depictions of naturist life, including family naturism, have long been recognized as constitutionally protected expression when they do not contain lascivious or unlawful content.
Since 1958, when the United States Supreme Court vacated a ruling against Sunshine & Health magazine in Sunshine Book Co. v. Summerfield, courts have repeatedly recognized that “nudity without more” is not, by itself, obscene or unlawful. Enature’s documentaries present naturism as a healthy, non-sexual, body-positive, and environmentally respectful way of life.
The publications, books, and videos offered by Enature, formerly known as Body-n-Mind, have been reviewed by independent attorneys experienced in First Amendment law. Enature does not offer material containing any lascivious exhibition of the genitals or pubic area, whether clothed or unclothed.
Legal review, advice, and representation for Enature has been provided by independent attorneys including:
- Stanley Fleischman, Los Angeles, California
- Barry Fisher, Los Angeles, California
- Jeffrey Douglas, Santa Monica, California
- Eugene Nathanson, New York, New York

Copyright matters have been handled by Eugene Nathanson in New York and Elliott Disner in Los Angeles. Legal reviews previously handled by Stanley Fleischman, Esq., now deceased, are currently handled by Barry Fisher.
Enature has always taken legal compliance seriously. Our content has been carefully reviewed, and where there is any doubt, we err on the side of caution. In addition to legal review of our DVDs and publications, Enature has obtained regular written updates regarding relevant United States case law. A detailed legal review prepared exclusively for Enature was completed on June 19, 2008, by a leading expert in laws relating to naturist content.
Enature also works with legal counsel in Europe and has shipped to customers throughout Europe, Canada, Australia, New Zealand, Asia, South America, and Africa for many years, subject to the laws of each destination country. Some of our films have been rated by the Australian Film Board and received the general equivalent of a PG rating in the United States. Our films and images have also been reviewed and accepted for import by Canadian Customs.
Upon careful review of our content, United States Customs advised us in person to continue selling our naturist material.
The naturists presented in our documentaries come from real naturist communities, many of which have practiced naturism for generations. They participate in these films to share the simple, healthy freedom of naturist living and to help others better understand the naturist way of life.
Portrayals of family naturism in documentary film continue to deserve the legal protection they have received since Enature began offering naturist documentaries on July 4, 1996.
